My opinion on this hasn't changed after going through the latest pages. For me it's still a private matter to be taken with a pinch of salt when broadcasted on such platforms. So I won't try to get into a debate about it with anyone or try to change anyone's mind. To each their own.

Just wanted to point out something, as a then mod, since it is being brought up. Indeed this was never added to the actual rules but it was certainly a common agreement between members and moderators. As far as Gizmo is concerned, he was also notified of it, and saw no reason to object it. So from that point forward all death announcements were immediately removed up until the moment the last of the 4 mods left (Achilles, Ash, Skar and myself). It may not have been an "official" rule, but it was certainly a common agreement that was enforced. And there sure were a lot to remove. After the last of us left, I cannot say.

The initial rules of the forum were written by a game member mod as well, and then in 2015 another mod corrected and rearranged them for gizmo to repost. So gizmo did trust his mods, and from there it's nothing but a simple step to add them to the rules, had we then thought was needed.

I'll also say that I don't quite see that trend around as it used to be, at least in an open fashion. Or they just get reported and removed quickly (lol), before my eyes get to them since I don't roam this forum as much I used to. God knows who actually mods this forum now and how, but that's a whole other endless discussion lol.

Thank you for clearing that up.  As I had pointed out you stated it was never a rule but because of the poll you did the mods would remove the death announcements.  I agree they don't seem to have run rampant either since the poll was done.  Even in the last 4 months as you stated were the last of the mods, there hasn't been a death announcement regarding a user but only famous people.  This is the first I've seen since coming back in 2017.  I know my best friend was on here and she never seen one. This thread was brought back up since a death announcement was made for ShovelHead, who had passed on May 15, 2019, his services are being held this evening, which is also his birthday.

I'll say this, death is hard no matter what.  Sometimes the relationships we build online be it friends, lovers or what you, understand something.  Sometimes when you talk to them over the phone, over a service like Skype, Discord, Line, What's app and so on if you actual speak to that person or even cam (not even sexually) with that person, sometimes you know more about that person then the people who know them physically in real.  Why because sometimes they don't know how to tell the physical person in real what's going on or don't feel comfortable.

As I said before, if there are to be no death announcements then there shouldn't be any at all, not tributes and so on.  That should be listed in parameters of the things not allowed so it can't be done and if done, removed.  I say this because there have been tributes to those that have passed even celebrities as I've stated before.  If we're going to say no more death announcements then it should be across the board that nothing is allowed at all.

When something will happen if someone will do something, this is a rule.

Maybe it wasn`t written in the actual "rules", but if someone from administration said that any new death announcement will be removed and it was, it seems like a rule. Actualy it was a rule. Because any statement from admins or mods is equal to the rule. I will demonstrate it by some interesting example:

zjULqdI.png

Like a rule, right? When many users didn`t agree with this, several people boldly operated with this phrase like a rule, all the time, in all topics about copied rooms. Every topic. Like a ... alright. Everyone knows.

For most of people it was a rule. But today this rule was died. So, this is a time to say good buy to the old rule and... get to party about it!

How funny.

I'm going to say this again so it's clear.  Read what Shanti wrote.  THERE WAS NO OFFICIAL RULE!  It was a poll that was voted on by the users,  If users posted death announcements it was removed.  This was the first time since I joined even with a break that a death announcement had been made.  The thread was removed and guess what, Gizmo put the thread back. So again it's never been an official rule and saying that it was a rule, is wrong.  There never was an official rule stating you can't post death announcements, ever.  The ones that have been posted of famous people including tributes of those that have passed are posted and there was no issue with them.

You posting what Gizmo stated isn't a rule, read it, it's a statement telling you simply you're using the internet and put something public anyone can access it.

I have to say that doesn't read like a rule at all to me. That seems like information and advice.

I guess you wasn't`there when this problem was actual.

Just in a nutshell.

Someone was able to copy any room that was opened for public by saved world file if I aint wrong. A little bit later we got an information that this is possible. A big part of really talented room(and not only) creators was upset because their own builds, arts, etc, was stolen or was able to be stolen. Those kind people and me(I ain`t so kind) was asking to punish somehow those robbers, because it was just unfairly. You can find some topics on our forum about it(some of them was closed because of stupid trolls, but was started new ones, because those trolls was stupid *giggles*). Then you can see a picture with what admin said. Sooo... what admin said? It was a smart step. He said that it is OK if someone can take your room by the file. Nothing rules about to punish those bad people. It was not stolen, it was copied. It is legal. Only in 3dxchat. His words were taken for rule, let and in such a the form of.

Not so in a nut, not so in a shell. But I hope you got it.

A question. If someone says - "If you create something wrong, I will delete it" -will anyone take it as a rule for such situation? "...all new death announcement topics will be deleted from the forum, and previously existing ones will be locked to prevent further comments". Isn`t it a rule? Maybe it wasn`t included to that official rules, but still a rule. I was wrong when I assumed that it was an official rule, I was wrong when I said to Vaughan to look on a rule first, while rule was in this topic, but I remember what Shanti told and everyone (except you as it seems) took it as a rule and it was fair. It was my main point. And it was deleted by reports. This rule was working while old forum mods was in here.

First of all here as in real life all rule/laws don't need to be written as long as they are enforced. If a rule is enforced then its a rule. Its completely up to them what the rules are and which they chose to enforce. Even in real life there are unwritten laws that may still be enforced by a court.

https://casetext.com/case/olsen-v-spoya?find=unwritten

"R.C.M. 1947, sec. 93-1001-11, defines unwritten law as follows: "Unwritten law is the law not promulgated and recorded, as mentioned in section 93-1001-8, but which is, nevertheless, observed and administered in the courts of the country. It has no certain repository, but is collected from the reports of the decisions of the courts and treatises of learned men.""

So the whole concept that a law or rule needs to be written down to be a rule is simply wrong at least in the United States, and other countries I am sure as well.

The items I put in red are rules that are in the terms and conditions that don't seem to be enforced on the forum, and in fact I think that some parts of the forum are basically dedicated to those things. basically the wording is broad enough to cover most anything, and is worded so that it's entirely up to the mods to decide. Some people for example might find death threads to be or harmful, or objectionable, and that seems to be the conclusion the mods reached in the past.

This is getting off topic from the main theme of this thread, but to correct your assumption, I was totally there when all that 'build stealing' was a 'problem' and I posted in those threads too advocating an open and sharing attitude to room building (and that's exactly what I did with my own builds). But that's fairly irrelevant to this thread, and doesn't change my view that Gizmo's posting you copied above about room building wasn't a rule.

Trying to get a little more back on topic, I'll add that societal "governance" can be applied by other methods than just rules. For example policy, principles, practices and guidelines are all different methods. I would suggest that "no death postings" was a principle or practice established by the old mods rather than a rule. But actually whether 4 years ago it was a rule, policy, principle, practice, guideline or even a condition scribbled down on the back of a piece of toilet paper ;) I'm not sure it really adds a great deal of value to the current debate. Clearly there was some kind of "decision" by the mods that death announcements should not be posted/kept.

I think greater value is achieved from the ongoing debate in this thread if it focuses more on what the current community members prefer regarding death announcements going forward, so that those that govern this forum (by ownership or moderation - yeah, I know moderation is absent at the moment) can hear those views and decide for themselves if they would like to change or refine any existing approach to death announcements.

I think the devs had a rule at that time that they wouldn't punish people for stealing rooms, and Gizmo's quote was the justification for how they planned to handle things.

Where are the mods to enforce the unofficial rule that was handled by the mods?  There haven't been Mods on here in a good few months if not longer.  I've been celebrity death announcements and tributes, they were not removed.  You see if this was even an unofficial rule that was being enforced all threads would have been removed but they weren't.  This poll wasn't brought back to life until after the death announcement of a user.

I agree there has been a lot of things that should have never happened on here but they have been allowed to. There isn't any Mods on here and hasn't been in months.  This poll revived after a thread over the passing of a user.  Now this thread sat dormant since 2015, so any new users would not have known about what the Mods were doing.  Given that Gizmo has put the thread back, it doesn't seem to be an issue with him.

I think the devs had a rule at that time that they wouldn't punish people for stealing rooms, and Gizmo's quote was the justification for how they wanted to handle things.

Gizmo only pointed out what anyone else would, it was never a rule that's why he said it.  It's on the internet where it can possibly be accessed by anyone.  So yes even with measures put in place, it still is possible to have whatever you put on the internet used, accessed, taken and so on.  There is only so much that you can control over the internet.

Since this topic is present for sometime now, and it was made because back in the day the DA's where getting out of hand and you saw people dying here on daily bases almost, I gotta admit it really toned down.

Havent seen alot ever since. Yes you can argue it wasnt made a rule or so long ago... Everything comes out sooner or later and if you look at the numbers, there where 9/10 people reincarnating from the death, so I dont really pay attention to all theese tributes and moaning events ect.

In my opinion if someone dies in here, the last thing the relatives would do, is informing some people on an adultgame. I think I ve said it some years ago and say it again.

Currently I have one friend missing from the game and noone knows anything about his absence. This smells more like something bad has happened, because noone was notified and just got M.I.A wich isnt really his stlye (If he leaves game he would say so, no biggie) but come on. Someone notifying you from the other end of the world that their loved one has passed away and its urgent that 3 people and a drum need to know on a sexgame? Yeah.

Feel free to believe that, feel free to do as many Tributes and Rememberings aswell. Just dont cry afterwards if it comes out as "Ooops I lied to you all, sorry" Story.

No. It is only a rule if it comes from Gizmo and is pinned somewhere that new users (AFTER 2015) can be aware of.  Till then it means nothing.  Were we expected to search every archived post/topic ever made from the beginning of the game?   Sorry but that is a bit unrealistic.

We have no idea if there is a mod looking after the forum right now or not, the only time I remember gizmo announcing mods was when the 4 mods were announced.

So we could have another secret mod that has not been announced like they have done for the last 2 I know of.

Since the 4 mods which included Shanti we have had at least 2 secret mods, one of which RobT was very happy to let everyone know he knew.

For all we know that mod may be back again, putting the thread back up may have had nothing to do with Gizmo, he may not even know anything about it.

Death threads have for a long time always been removed, last one I remember was about 2 years ago where it was only up for around an hour.

I remember 2 since Shanti and the other mods stopped being mods, and as Shanti said there were quite a few that they had to remove when they were modding.

I wouldn't be surprised if this one wasn't reported at all as I don't think that since this thread was done they ever had to be, they were just simply seen and removed.

As for it being a rule or not, it was definitely an understanding that most people knew about and agreed with.

There are lots of unofficial rules that we live by, ones where communities just accept things should not be done, others where it is well known that people don't like particular things so people consider the majority and don't do them.

So arguing that it is not an official rule and trying to make it sound ok to do it because it was not added to the forum TOS, makes it sound like you are putting your opinion above everyone else.

It is not something where people are being treated unfairly, not something where people are being discriminated against or really disadvantaged in any way.

It is something that for lots of different reasons the majority of people do not want to see in the forums.

It may not have been known by the poster when he 1st placed the thread, but to argue it should be allowed this time, and to go further and ask or insist it should be put back up is definitely not respecting what the majority want.

It is saying you want to be able to do something that very much everyone else had agreed not to, because you feel that things may have changed.

My opinion on that is it has not changed, it is very likely still by far the majority of people do not want to see death threads.

That is only my opinion, as yours is yours, but to insist it be allowed based on your opinion, and try to have us all accept this time should be classed as different because it is you and your opinion is a show of arrogance.

The poll may have been taken 4 years ago but there has been nothing to suggest it would be any different if one was taken today, so the only thing we have to go on is that poll.

You can question it, you can create another poll if you want, I doubt any real objections will come from that.

But to go about things the way you have, to try insist on it being ok because it is not an official rule, to insist that your opinion should count over what has been decided in the past where there has not been any verification what soever that things have changed.

To try to insist it is ok because it is you doing so.

It is all a show of arrogance and disrespectful to what was decided in the past by not only the majority, but also official mods and Gizmo himself.

If it was Gizmo that put the thread back up, I believe he made a mistake.

Actually the person that passed that brought this thread back to life has actually passed.  Three people have been in contact with the police department he worked for, I was am one of them.  I actually spoke to his boss to pass on condolences to the department.  Their funeral was last night, their birthday, so his family has that to remember every time May 30th rolls around.  Not only are they no longer celebrating his birthday but they're mourning his passing.  Several of us actually talked to him out of game.  He and I made plans to meet up since we live 20 minutes apart.  He was busy and so was I, so we figured once we both slowed down a bit, we'd meet at WaWa which is a convenience store here.

Gizmo said that 3dxchat has a problem with forum moderation(was connected with problem about registration on this forum), it was not so long time ago, but last death announcement was removed. Then it was recovered. We was talking about that today this old "rule" isn`t working. I can`t understand why you continue this, because everything was explained in here. It was a rule and not important official or not.

Really, who didn't know that.  It's been that way even when there was Mods as you should recall, which is why there are none as they left the position.  When you have multiple accounts created by one person to continue to harass users on here which some have done and continue to do, I'd say that is still a problem.  Hell someone who's no longer on here is accused of being on here, which they're no longer in game either as they let their sub expire.  Yes, it was removed and Gizmo put it back.  There haven't been any user Mods since at least 2017 when I came back.  The only people enforcing any rules have been the Devs to which we know hasn't been done as it should be.  That's been another matter that has been discussed.  Me continue it, you're the one who keeps going on and on about it, which people not just me are responding to.  I did explain it clearly, even pointed it out to you what are the actual facts of it being a rule or not.  It was never an official rule just something the user Mods did when they were Mods as users voted to have them removed.  This topic was dead until a user made a death announcement of another user.  That user that made the post stated they had not seen this post as it hasn't been active since 2015, yes, that's right 4 years, so explain to a person who they're going to know of an unofficial rule that was not known or seen as they're going by the actual rules the forums sets for posting.  This is not listed in that.  So any user joining and posting a death announcement past the time that this thread was seen isn't going to know about it.

I'm going to break it down to be really simple.  We don't truly know the person behind the computer.  There are rare instances where you actually speak (voice) to the person, cam with them or hell even meet them because of locations or where you may be.  So we don't know their actual birthdays because they can tell you anything so why host parties for their birthday and make announcements for it.  Weddings, it's not a real wedding so why do the whole getting married hosting a party bit then once the divorce happens why not celebrate that.  Awareness and so on that are done.  In case it hasn't been pointed out look at the cesspool called World Chat.

I see death announcements for people who have passed on and tributes made for it on here for famous people who they've never met and never will.  If the "unofficial" rule is going to be enforced then all announcements and tributes shouldn't be allowed or announced, it's that simple.  While that may sound fucked up, it's as blunt as can be.  I'll leave it at that.

My Game My Way. if i want to host or Help with or Support or post 1000 tributes a day, and Everyone turns out to be untrue then I will.. Everyone is entitled to their Opinion, but the PC Bullshit I am just over with. Most of Y'all missing the bigger picture here as normal which is tomorrow is Never promised. Instead of bickering and fighting and trying to control others try Loving your neighbor its much more satisfying..

And here I thought Superman was considerate towards others, it appears this one doesn't care what the majority want, he will just do as he wants.

Nikki talked about the possibility of what might happen if such topics will be in fashion again. She didn`t say that your story isn`t true.

This is true. That is why one of users reminded about it.

Have a good time. Thanks for participating.

That post right there makes it clear.  No one who joined in 2016, 2017, 2018 or 2019 is going to know about an unofficial rule unless they posted a user death announcement which I've been back since 2017, did not see any User Mods only Gizmo, Lisa, 3DX Help and 3DX Moderator (which is now removed).  Since this topic was not pinned no user joining from 2016 on is going to know about this. It's not forcing an opinion on others, but simply stating that how is a user going to know about it, they won't if they're going by the official rules they agree to when they sign up for the game and forum as it's not listed on there.  This was a user voted rule that the User Mods managed.  As far as secret Mods, I know RobT wasn't one, he joked about it but he wasn't, all he did was report it and then sent a message to Gizmo much like others do.  The person that brought the topic back up would have to be an old user under a new name to have known about it from 2015 as their profile states they joined in 2018.  There hasn't been a user death that has been stated in game or on the forum, which has been for the person that brought this thread back up due to their death announcement being posted.

If we're going to point out unofficial rules for users to follow then I would suggest that all unofficial rules be put on the official rules so in the future there isn't any issues as to what is or isn't on the official rules.  When reports are being filed against other users the official rules are what most are going to when doing the reporting.  If they don't know of an unofficial rule, how are they going to report it for breaking that rule, you simply can't.  What has been pointed out is that users who joined after this was done don't know about it.  As I suggested add it to the official rules and if not then have it pinned for all future users to see and know that it's an unofficial rule and their thread will be deleted.  As I said, do it for all deaths and tributes so it's the same across the board.

It should be moved to Read First as well so all users can see it as this is under Open Forum and would to have been searched and will again in the future with the amount of topics that are made.

I think this needs to be made clear. It is not a rule of the game. It’s not part of the terms and conditions for playing the game, nor in using and being a part of forum.

It was purely an agreement made by forum members 4 years ago because it seems there was an excessive posting of fake deaths

I was not a member of the game 4 years ago, nor a member of this forum.

As such I nor anyone else who was here after Oct 2015 was probably even aware of this agreement.  The topic had fell way back into the archives and no one would have any reason to delve back into them. It was never pinned anywhere to say the agreement is relevant today, 4+ years on, or that it was expected to be abided by.

I will and do argue it’s not relevant now and as my topic was reinstated, it does seem to suggest to me that it is not a recognised forum agreement that is absolute.

It seems wisely that 3DXChat will judge every case on its merit.

I would also like to point out there is no disrespect to any members who have an opposing view.

An agreement was made by the Forum 4 years ago, nothing was discussed on it from Oct 15.

I then posted a death announcement, not even knowing or realising the controversy it would cause.

My intentions was to inform members past and present about his passing, who knew him or of him.
It worked, I succeeded and reached his friends and colleagues I may not have done otherwise.

This is a public forum for the game. I used it to publicly announce my friends passing.  I do not feel there is anything wrong with it.
I broke no rules in the game and my announcement was respectful to him, his friends and to Forum.

This is exercising my right to free speech.  You may not like what I am saying, you may not agree with what I am saying… but as long as I break no laws or Forum rules set down by the game… I have every right to express them… as do you.

After my post, someone then decided to dive into the archives and point out this 4 year agreement that only 4 year plus forum members would remember.

Maybe it was relevant then, but I question whether it is now.
I also question whether a sledgehammer was used to crack a nut.

In the time I have been on forum, (Oct 2017) Death announcements certainly have not been an issue.  In fact any of those that have been announced, usually well-known celebrities, have been allowed, to run on naturally. Was there any issues?  None that I saw. They ran their natural course and fell back into the archives.

So what if a death announcement is fake… people will post their respects and then it will fall back into old news as new topics take over.

Those that are found to be fake, will no doubt suffer at the hands of their friends by public denouncements and lose a once valued circle of friends… I’d say leave the topic up as a warning to others.  Post rubbish thats falsly emotive, You will loose friends and your credibility.

If you don’t know the person, you may post a few lines of respect or not but if you do know the person, it is a nice way of saying goodbye, documenting your memories and paying respects.

The members who do not like death announcements for whatever reason can just not read them, pass over them and simply read topics they do find interesting.

But to delete them all, takes away my right to free speech, my right to read obituaries, my right to post and take part in them.

By not allowing me and others like me to post freely within the boundaries of the game and statutory laws is censorship.

Now that is wrong!

This Forum is not a dictatorship and we all must learn to respect one another and agree to disagree on occasions.

Vote No in this pole.  This protects our freedom of speech and stops over censorship.

I said in your post, yes, you`re right. I will say more, this rule should be official and would be great to see few words from gizmo about it.
